By passes sentencing guidelines under certain circumstances. SOME FLEXIBILITY SHOULD BE ALLOWED FOR OUT JUDICIARY, but that MUST be clearly laid out in statute and not leave room for Judges to circumvent the sentencing guidelines altogether.
